Employee Free Choice Act

The Metals Service Center Institute (MSCI) is seeking to block passage of the Employee Free Choice Act (EFCA), a bill that will guarantee significantly more union certifications and which is certain to be reintroduced to Congress in 2009. We believe passage of this legislation will be damaging to member companies, their customers and the economy. 

Very simply, organized labor has identified EFCA as its top legislative priority (see http://www.aflcio.org/joinaunion/voiceatwork/efca or http://www.cwa-union.org/efca) and has spent more than $55 million supporting Democrats running for the U.S. House and Senate on the understanding that, in return, they will reciprocate by approving this and other favorable legislation.

EFCA would do away with the protections of the secret ballot in elections to determine whether a union will be certified to represent a workplace. Under existing law, the National Labor Relations Board calls a union certification if 30% of employees sign a card asking for one. The NLRB supervises all aspects of the election so that it is fair and as free from coercion, threats, and pressure tactics as it can be. The secret ballot is one of the most important protections givens to employees in this process and it is one of the most sacred pieces of our democracy.
