Commerce Alters Section 232 Rebuttal Process

On Thursday, Sept. 20, the U.S. Commerce Department confirmed that a new system for rebutting Section 232 steel and aluminum product requests is operational. The department said exclusion requesters will have seven days from the opening of the rebuttal period to submit rebuttals. Objectors to exclusion requests will then have a seven-day period to post responses, which will open once the Commerce Department posts rebuttals and the case file is reopened. The new rules provided more detail to an announcement Connecting the Dots reported a few weeks ago.

As CNNMoney explained, the new system will give companies “more time to respond when other companies try to block their exemption requests.”

The Commerce Department also noted in its announcement that, to further assist industry moving through the process, it will catalogue the Objection, Rebuttal, and Surrebuttal Identification Number associated with each exclusion request. The Aluminum Rebuttal and Surrebuttal Finder and the Steel Rebuttal and Surrebuttal Finder will be uploaded each day at www.commerce.gov/232.
