The Impact of #MeToo on the Workplace: Positive Changes and Unintended Consequences. What Does It Mean for Employers?

Since late 2017, numerous business organizations – along with many of their powerful leaders – have been rocked by allegations of sexual harassment. After hitting a two-decade low in 2017, sexual harassment complaints to the EEOC increased by more than 12% in 2018. Over the same period, the federal agency increased the number of sexual harassment lawsuits it filed by more than 50%.  State and local legislative bodies were also active, passing a range of laws designed to protect victims of harassment and promote gender equality in the workplace. Meanwhile, employers scrambled to assess risks within their workplace and take actions to prevent sexual harassment.

Each of these trends and developments was inspired by the #MeToo movement, a social media-fueled initiative that shined a bright spotlight on the issue of sexual harassment in the workplace. There is little question that the movement has increased the collective awareness of sexual harassment and gender discrimination. And by many measures, the #MeToo movement has spurred behavioral adjustments and other positive changes in workplaces across all industries. Yet, recent studies reveal that the increased focus on sexual harassment has resulted in confusion about workplace etiquette and, paradoxically, the possibility of fewer opportunities for women, as executives, supervisors and managers adopt and adjust to new rules of interaction.

So, what does it all mean for employers?
