New Presentation Available For MSCI’s Members Explains California Prop 65 Changes

California’s Safe Drinking Water and Toxic Enforcement Act, known as Proposition 65, was enacted in 1986 after being approved by voter referendum. Through warnings and labeling requirements, the law requires businesses to inform consumers about exposure to certain chemicals. In August 2018, the state implemented updated regulations for what constitutes a clear and reasonable warning.

In a recent presentation to the American Copper Policy Council, the law firm Kelley Drye discussed the basics of the law, the changes made to the warning system, and general enforcement of its provisions. As a reminder, the Office of Environmental Health Hazard Assessment (OEHHA) administers Proposition 65, but the state attorney general, district attorneys, and city attorneys enforce it.
