Supreme Court Rules Out-Of-State Retailers Must Collect Sales Tax

On Thursday, June 21, the U.S. Supreme Court handed down a decision in the Wayfaircase overturning the Quill decision and allowing states to require out-of-state/on-line sellers to collect state sales taxes. The case is considered a huge victory for brick-and-mortar businesses.

However, the practical, immediate outcome of the case could be a “wild-wild west” situation in which the states individually begin the process of collecting the tax causing some confusion for on-line venders and states alike. This situation could compel Congress to pass legislation that would streamline the sales tax collection processes going forward.
