On February 10, 2014, the administration announced the final regulations for the Employer Mandate of the Affordable Care Act (ACA), better known as ObamaCare. While some transitional relief was provided, employers with 50-99 full-time equivalent employees (FTE) are expected to satisfy the requirements of the Employer Mandate by 2016. Address

While the employer mandate was delayed, the ACA’s insurance reforms weren’t – and compliance was still required beginning in 2014. Required items include restricted waiting periods, elimination of pre-existing condition exclusions and events outside of the ACA, such as updates to policies based on the Supreme Court’s decision on the Defense of Marriage Act.

Implement

The Employer Mandate is in full swing. With the release of the final regulations, many questions were answered, including: When exactly is an employer expected to be fully compliant? Am I a large employer? Who are my variable hour employees? What reporting is the IRS expecting from me?

Execute 

The time to act is now! The government is taking a more active role in health insurance coverage for employees by putting rules in place to ensure that employers are doing their part and giving themselves the authority to assess penalties for non-compliance.
