U.S. Commerce Department Issues Preliminary Determination On Chinese Aluminum Exported from Vietnam
The U.S. Commerce Department announced last week that it had preliminarily determined that extruded aluminum products that are made from aluminum previously extruded in China and are exported from Vietnam constitute merchandise completed or assembled in other foreign countries and are circumventing the antidumping duty (AD) and countervailing duty (CVD) orders on aluminum extrusions from China. The determination applies, the department said, regardless of producer, exporter, or importer.
The Commerce Department also is considering whether to require that importers and exporters of these extrusions who claim that their merchandise is not subject to the AD/CVD orders certify that their aluminum extrusions are made from aluminum not previously extruded in China. Public comment on this matter is open until June 17, 2019.
A final determination with respect to this anti-circumvention inquiry, including the results of Commerce’s analysis of any written comments, will be issued no later than June 7, 2019, unless extended.
