CDW Asks NLRB To Accept Amicus Brief Regarding Union Election Challenges
The Coalition for a Democratic Workplace (CDW), which MSCI is a member of, has filed a motion with the National Labor Relations Board (NLRB) requesting that the board accept the CDW’s amicus brief in Armaz Products.
In this case, NLRB General Counsel Jennifer Abruzzo had asked the NLRB to penalize employers for utilizing their National Labor Relations Act (NLRA)-guaranteed right to challenge union election results. Abruzzo’s changes would have a chilling effect on employers. CDW’s brief, which is available here, opposes the general counsel’s proposed remedy.
CDW argues the radical proposal would require the NLRB to overturn one of its most longstanding and established precedents; chill the rights of every employer seeking to petition the courts to review the NLRB’s certification of a union; violate the NLRA, the U.S. Constitution, and numerous Supreme Court holdings; and severely undermine the integrity of the NLRB.
The brief calls on NLRB members to reject the general counsel’s proposed new remedy in this case as well as in any other case where she has filed the same or a similar motion.
